Representation before all four divisions of the Immigration and Refugee Board, where refugee protection, sponsorship, removal and detention are decided.
The Immigration and Refugee Board of Canada (IRB) is Canada’s largest independent administrative tribunal, and it decides some of the most consequential matters a person can face: whether you receive refugee protection, whether a sponsorship refusal stands, whether you may be removed from Canada, and whether you should be detained. Appearing before the IRB is not paperwork. It is advocacy, and it rewards preparation.
The IRB has four divisions. Knowing which one your matter sits in, and the rules and deadlines that govern it, is where representation begins.
The RPD decides claims for refugee protection. If you claim at a port of entry, your Basis of Claim (BOC) form is due within 15 days, and a late BOC can be treated as an abandoned claim. Most claims are decided after an oral hearing where credibility and country-condition evidence are tested. The record you build here shapes everything that follows.
The RAD hears appeals from RPD refusals. The notice of appeal is generally due within 15 days of the written reasons, and the appellant’s record within 45 days. The RAD usually decides on the written record, so the quality of that record is decisive. It can confirm the decision, substitute its own, or send the matter back to the RPD.
The ID conducts admissibility hearings and detention reviews. If you are alleged to be inadmissible, for criminality, misrepresentation or other grounds, or if you are held in immigration detention, this is where your status and your liberty are decided. These hearings move quickly and the stakes are immediate.
The IAD hears immigration appeals: refused family and spousal sponsorships, removal orders, and residency-obligation decisions. A right of appeal here is valuable and, in criminal cases, can be lost at sentencing, so early advice matters.
