Can Canada Cancel a Visa After Approval? Understanding R180.1

An approval can feel like the end of the uncertainty. It is not always. A visa already in your passport can still be taken away, and the reason can carry consequences well beyond a cancelled trip.

Most travellers assume that once a visa is issued, the decision is final. In fact, Canadian law gives officers a defined power to cancel a temporary resident visa after it has been granted, and the circumstances are broader than people expect.

What R180.1 allows

Under section 180.1 of the Regulations, an officer may cancel a temporary resident visa where, among other things, the holder is inadmissible, no longer meets or never met the requirements for the visa, or is subsequently refused another immigration document. Because misrepresentation under section 40 is a ground of inadmissibility, a concern about a false document or an inconsistent account can reach back and undo an approval.

What tends to trigger it

The patterns are familiar. An employment or financial document that is later found to be fraudulent. A stated purpose that does not match reality, a short tourist visit that turns out to be months of study, with no return ticket to support the original story. What looked like an approved visa becomes a file reopened.

The critical question is the basis of the cancellation. A cancellation on a narrow, technical ground is one thing. A cancellation built on a finding of misrepresentation is another, because it can carry the five-year bar under section 40. Two cancellations that look similar can have very different futures attached.

Why the response window is dangerous

These letters usually allow only a short time to respond. The temptation is to explain quickly and move on. But the response can shape not just whether the visa is restored, but whether a misrepresentation finding, with its lasting consequence, is made. The difference between a careful response and a careless one is measured in years.

读懂 R180.1

R180.1 允许什么
