An order or agreement for support is only as good as its enforcement. In Ontario, the Family Responsibility Office has real teeth.
In Ontario, court-ordered support is automatically filed with the Family Responsibility Office (FRO), which collects payments from the payor and sends them to the recipient. A support term in a separation agreement must first be filed with the court and registered with FRO before FRO will enforce it.
FRO's tools are significant: garnishing wages and bank accounts, intercepting federal payments, suspending a driver's licence, reporting to credit bureaus, and in some cases suspending a passport or starting court enforcement.
Where a payor lives outside Ontario or outside Canada, support can often still be enforced through reciprocal arrangements, though the process is more involved. Advice makes the difference between collecting and giving up.
