In Ontario, the home you lived in as a couple has a special legal status. Even a spouse who does not own it has rights that can surprise everyone.
Ontario family law singles out the matrimonial home for special treatment. After separation, both married spouses have an equal right to stay in it, no matter whose name is on title. One spouse cannot simply change the locks or force the other out.
While both spouses have possession rights, the home generally cannot be sold or mortgaged without the other spouse's consent or a court order, even if only one of them legally owns it. This protects a spouse from waking up to find the family home sold out from under them.
There can be more than one matrimonial home, a cottage or second property used by the family may also qualify. Which properties count, and how possession is resolved, is fact-specific and often contested.

Book a Consultation
