If your work permit is about to expire and your employer's LMIA is still pending, IRCC now gives you more time. Here is exactly who qualifies, and the one mistake that turns this relief into a refusal.
When you apply from inside Canada to extend a work permit but your new LMIA has not yet been issued, IRCC holds your application while you wait for the positive LMIA. That holding window has been extended from 60 days to 90 days from the date IRCC receives your application. IRCC will not make a decision until it receives your LMIA, so the longer window is real breathing room for applicants caught by slow LMIA processing.
This is narrow relief, and all of the conditions must be met at once. Under IRCC's current guidance, you can apply to extend your work permit without the LMIA in hand only if:
your current permit will expire in less than two weeks; and
your employer has already submitted a complete LMIA application to Service Canada.
When you apply, you must include both proof of a valid job offer and proof that the LMIA request was made, and you must enter the LMIA request details (the date sent, the office, the employer's name and the confirmation number) in the Details of intended work in Canada section of your application.
If your permit expires within two weeks and the LMIA is pending. You can file now, but file correctly: the proof of the LMIA request and the job offer must be in the application, and the request details must be entered accurately. A missing document or a wrong entry can sink an otherwise valid extension.
If you applied before your permit expired. You generally have maintained status and may keep working under your existing conditions while IRCC processes the extension. This is valuable, and it is also easy to get wrong, so confirm your status before you rely on it.
If the 90 days is running out. Do not wait for the refusal. There are steps that can be taken while the application is still open, and options if a decision has already been made against you.
We make sure the extension is filed correctly the first time, with the right proof and the right profile entries, and we track the LMIA clock so a processing delay at Service Canada does not become a loss of your status. If a refusal has already happened, we handle restoration, reconsideration and judicial review.
