Child support is a child's right, not a bargaining chip. The Guidelines set a baseline, but the real disputes are usually about income and the extras.
Under the Federal Child Support Guidelines, the basic monthly amount is set by a table, driven by the paying parent's income, the number of children, and the province. It is meant to be predictable. The fights are usually not about the table itself, but about the number that goes into it.
Determining income is rarely straightforward where a parent is self-employed, paid partly in cash, holds assets through a corporation, or works abroad. A court can impute income where the stated figure does not reflect reality. Getting this right is often the whole case.
On top of the table amount, section 7 allows certain special or extraordinary expenses, child care, health costs, significant extracurricular activities, post-secondary education, usually shared in proportion to the parents' incomes.

Book a Consultation
