Relocating with a child after separation is one of the most contested areas in family law. Move without following the rules, and a court can order the child back.
A parent who wants to relocate with a child must generally give the other parent written notice at least 60 days before the move, setting out the date, the new location and a proposed new schedule. This is not a courtesy, it is a legal requirement.
The other parent typically has 30 days to object. If they do, the move generally cannot happen until a court decides whether it is in the child's best interests. Moving anyway can lead to an order returning the child.
Courts look at the reasons for the move, its impact on the child's relationships, the distance, and whether the proposed arrangements are realistic. A genuine, well-planned proposal stands a very different chance from an abrupt one.
