A will that was changed late in life, under pressure, or when the person was not themselves, can sometimes be challenged. But suspicion alone is not enough.
A will can be challenged on several grounds, that the person lacked the mental capacity to make it, that they were unduly influenced or pressured, that they did not know and approve of its contents, or that it was not properly signed and witnessed. Each is a distinct legal test with its own evidence.
Families often feel a will is unfair, but unfairness is not a ground to set it aside. A successful challenge needs evidence, medical records, the circumstances in which the will was made, the role of those who benefited. These cases are fact-intensive and often emotionally charged.
There are limitation periods and practical deadlines, and evidence fades quickly after a death. If something about a will does not look right, the time to get advice is early, not after the estate has been distributed.

Book a Consultation
